REPTILE & EXOTIC PLANT MEGA SHOW 2026 LIABILITY WAIVER AND RELEASE AGREEMENT

IMPORTANT: THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS, INCLUDING CLAIMS FOR NEGLIGENCE. PLEASE READ CAREFULLY.
By purchasing a ticket, registering for, or attending the Reptile & Exotic Plant Mega Show 2026 (“Event”), I, on behalf of myself and, if applicable, any minor for whom I am the parent or legal guardian, acknowledge and agree to the following:
1. Assumption of Risk
I understand that participation in the Event involves inherent risks, including but not limited to:
Exposure to allergens, including but not limited to, mangos and other tropical fruits, nuts, all types of plant life, animal fur, and all forms of animal contact or interactions which may cause allergic reactions, including severe or life-threatening reactions.
I understand there is an inherent risk in being around or in close proximity to reptiles, amphibians, all forms of insect, fish and all other forms of animal life, including but not limited to their enclosures and all surfaces.
Consumption of food and beverages provides by independent third-party vendors, including risks of foodborne illness, contamination, or improper food handling.
Exposure to communicable diseases, including but not limited to COVID-19, influenza, or other contagious illnesses.
Risks associated with large indoor gatherings, including but not limited to crowded conditions, long lines, limited seating, restricted movement, slips, trips, and falls.
Injury or damage arising from interactions with other attendees, vendors, equipment, or unforeseen incidents.
Risks related to weather conditions or other unforeseen circumstances affecting travel to or from, or conditions within, the Event.
I voluntarily assume all such risks, known or unknown, and accept full responsibility for my participation in the Event.
2. Release of Liability
To the fullest extent permitted by Florida law, I hereby release, waive, and discharge Xains World Expos, its officers, directors, employees, volunteers, sponsors, vendors, contractors, venue operators, and affiliated (collectively, the “Released Parties”) from any and all claims, demands, causes of action, liabilities, damages, or expenses of any kind, including but not limited to personal injury, illness, death, property damage, or economic loss, arising out of or related to my participation in the Event, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.
3. Third-Party Vendors
I acknowledge that food, beverages, merchandise, and services at the Event may be provided by independent third-party vendors. I understand and agree that the Released Parties are not responsible for the acts, omissions, products, or services of such third parties.
4. Medical Treatment
I understand that in the event of a medical emergency, reasonable efforts may be made to obtain medical assistance. Consent to such care if necessary and assume full responsibility for any medical costs incurred as a result of my participation in the Event.
5. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, or expenses (including attorney’s fees) arising out of or related to my actions, omissions, or negligence at the Event.
6. Media Release
I grant Xains World Expos and its designees the irrevocable right and permission to photograph, record, and use my name, likeness, image, voice, and appearance in any media now known or later developed, for promotional, marketing, or other lawful purposes, without compensation or further consent.
7. Minor Participants
If I am purchasing a ticket for or accompanying as minor, I certify that I am the minor’s parent or legal guardian and have the legal authority to execute this Agreement on their behalf. I agree that the terms of this Agreement apply to the minor and agree to indemnify and hold harmless the Released Parties from any claims brought on behalf of the minor.
8. Governing Law
This Agreement shall be governed by and construed in accordance with he laws of the State of Florida.
9. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10. Acknowledgement of Agreement
I acknowledge that I have carefully read this Agreement, fully understand its terms, and understand that I am giving up substantial legal rights, including the right to sue. I acknowledge that I am agreeing to this Agreement freely and voluntarily.
BY PURCHASING A TICKET, REGISTERING FOR, OR ATTENDING THE EVENT, I AGREE TO THIS LIABILITY WAIVER AND RELEASE.

IN NO EVENT WILL TICKETOR, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THIS WEBSITE, ANY CONTENT ON THIS WEBSITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THIS WEBSITE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.
